# Overeenkomst tussen het Koninkrijk der Nederlanden en de Republiek Oeganda inzake de tewerkstelling van ontwikkelingswerkers uitgezonden door de SNV, Organisatie voor ontwikkelingssamenwerking en bewustwording
### Artikel 1
**1.** The Netherlands Government shall within the limits imposed by the availability of manpower, material and financial resources, dispatch technical assistants to serve in specific development projects in Uganda selected for this purpose.
**2.** The Netherlands Government shall entrust the implementation of that part of this Agreement for which it is responsible to SNV-Netherlands Development Organisation (hereinafter called SNV).
**3.** Should the Netherlands Government contribute towards the financing of a project, financial resources will be supplied via SNV.
**4.** The details of the implementation of this Agreement shall be arranged between SNV and the competent Ugandan authorities.
### Artikel 2
**1.** The Ugandan Government shall afford the technical assistants all the assistance they may reasonable require for the satisfactory performance of their duties.
**2.** During the period of their stay in Uganda the technical assistants shall respect the laws and regulations in force in Uganda.
**3.** Subject to prior consultation with the Ugandan Government, representatives of the Netherlands Government or of SNV may observe the progress of work in connection with the projects mentioned in Article 1, paragraph 1.
**4.** In order to enable the Organisation to discharge its responsibilities in Uganda the Ugandan Government is prepared to receive a resident representative of the Organisation and necessary staff.
### Artikel 3
**1.** The Netherlands Government shall have the right to recall a technical assistant, after consultation with the Ugandan authorities. If possible, however, such action should not impair the execution of the project or programme to which the technical assistant has been assigned.
**2.** The Ugandan Government shall have the right to request the Netherlands Government to recall a technical assistant if his personal or professional conduct justifies such a measure. The Ugandan Government shall not however, avail itself of this right before having lodged a complaint with the authorised representative of SNV in Uganda.
### Artikel 4
The Netherlands Government shall:
a. take responsibility for the pre-assignment training of technical assistants prior to their arrival;
b. meet the cost of social insurance, allowances paid in the Netherlands and passages between Uganda and the Netherlands for all technical assistants;
c. furnish the technical assistants with such personal and professional equipment as is deemed necessary for the effective execution of a project (the equipment in question shall remain the property of the Netherlands Government unless, by mutual agreement, the ownership thereof has been vested in the Ugandan Government).
### Artikel 5
The Ugandan Government:
a. provides the technical assistants, where possible, with free housing at places where they are to perform their duties;
b. agrees that local institutions and organisations must where possible contribute to the salaries of technical assistants, by paying them the salary which would be received by a Ugandan employee of comparable rank.
### Artikel 6
**1.**
The Ugandan Government shall:
a. exempt the technical assistants and their dependents from import, export and customs duties on new or used household effects and personal belongings and professional equipment, provided such goods are re-exported at the time of departure or within such period as may be agreed upon by the Ugandan Government;
b. exempt from all import and export duties and other official charges the equipment (including motor-vehicles and spare parts) and other supplies provided by the Netherlands Government or SNV and destined for the implementation of agreed projects, or the Bureau of the Representative of SNV in Uganda;
c. make provisions for the clearance and temporary storage at the place of arrival of the equipment mentioned in Article 4;
d. make provisions for duty-free importation or purchase from bond of one motor-vehicle by the technical assistant within six months of first arrival in Uganda provided that such vehicle, if sold to a person not likewise privileged, shall be subject to payment of an import duty based on the estimated value of the vehicle at the time of its being sold;
e. exempt from all taxes and other fiscal charges all emoluments received by the technical assistants from Netherlands sources as payment for their services;
f. grant the technical assistants, as far as all their Netherlands remunerations are concerned, the most favourable exchange facilities applicable to non-residents;
g. provide the technical assistants, free of charge, with work and residence permits as and when required for the implementation of the project, and with identity documents to ensure that they receive the full assistance of the appropriate Ugandan authorities in the performance of their duties;
h. provide the technical assistants and their families with permission to enter or leave the country at any time, subject only to the applicable immigration laws of Uganda and offer them such repatriation facilities in time of national or international crisis as may be reasonable under the circumstances;
i. exempt the technical assistants and their families from the payment of fees and any other charges relating to visas;
j. exempt the technical assistants or their dependents from national service obligations in Uganda;
k. grant the technical assistants immunity from legal action in respect of any acts done and words spoken or written in their official capacity.
**2.** The preceding paragraphs of this article shall equally apply to those technical assistants who, after termination of their first period of service, are engaged for a new period of service.
### Artikel 7
**1.** The Government of Uganda shall indemnify the Government of the Kingdom of the Netherlands, SNV and the technical assistants against any extra contractual civil liabilities arising from any act or omission on the part of one or more of the said individuals, in the course of the performance of their duties under this Agreement, which causes the death or physical injury of a third party, or damage to the property of a third party - in so far as not covered by insurance - and shall abstain from making any claim or instituting any action for extra-contractual liability unless such liability derives from wilful misconduct or gross negligence.
**2.** If the Ugandan Government indemnifies the Netherlands Government, SNV and the technical assistants against a claim at law for extra-contractual civil liability in accordance with paragraph 1 of this article, the Ugandan Government shall be entitled to exercise all rights to which the Netherlands Government, SNV and the technical assistants would have been entitled.
### Artikel 8
The provisions as contained in Article 6 and in Article 7 of the present Agreement shall equally apply to the Representative of SNV in Uganda and to his non-resident staff.
### Artikel 9
**1.** The present Agreement shall enter into force on the date on which the Netherlands Government and the Ugandan Government have informed each other in writing that the constitutional requirements in their respective countries have been complied with.
**2.** The present Agreement shall be valid for a term of three years and shall be renewable by tacit consent for similar periods afterwards, unless one of the Governments notifies the other at least six months before expiry of the current period of its intention to terminate it. On termination of the Agreement by either party, all on-going commitments should be carried to their conclusion.
**3.** Any dispute between the Government of Uganda and the Netherlands Government concerning interpretation or application of this Agreement shall be settled amicably through established diplomatic channels.
**4.** As regards the Kingdom of the Netherlands this Agreement shall apply to the Kingdom in Europe only.
