Overeenkomst tussen de Benelux-Staten en Mongolië inzake de vrijstelling van de visumplicht voor houders van een diplomatiek paspoort en houders van een officieel/dienstpaspoort
Artikel 1
In this Agreement, unless the context indicates otherwise:
-
- „Benelux States” shall mean the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;

„Territory” shall mean:
– For the Benelux States: the joint territories in Europe of the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands; – For Mongolia: the territory of Mongolia.

– – For the Benelux States: the joint territories in Europe of the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands; – – For Mongolia: the territory of Mongolia.
Artikel 2
The Competent Authorities responsible for the implementation of this Agreement shall be:
a) a) for Mongolia, the Ministry of Foreign Affairs of Mongolia; and b) b) for the Benelux States: for the Kingdom of Belgium, the Federal Public Service Foreign Affairs, Foreign Trade and Development Cooperation, for the Grand Duchy of Luxembourg, the Ministry of Foreign and European Affairs and for the Kingdom of the Netherlands, the Ministry of Foreign Affairs.
Artikel 3
1. Nationals of Mongolia who are holders of a valid diplomatic passport and nationals who are holders of a service/official passport may enter, the Benelux States’ territory without a visa and stay in the territory for a period not exceeding ninety (90) days in any period of 180 days.
2. Nationals of a Benelux State who are holders of a valid diplomatic passport and nationals who are holders of a valid service/official passport may enter the territory of Mongolia without a visa and stay for a period not exceeding ninety (90) days in any period of 180 days.
Artikel 4
1. Nationals of the State of one Party assigned to a Diplomatic mission, Consular post or a mission to an international organization located in the State of the other Party bearing a valid diplomatic passport and nationals bearing a valid service/official passport may enter, depart and stay in the territory of the receiving Party without a visa for the duration of that person’s accreditation.
2. The State of one Party shall notify the State of the other Party in advance through diplomatic channels on the posting and function of the officials mentioned in paragraph 1 of this Article and these officials shall comply with the accreditation regulations of the other Party.
3. Family members of the persons specified in paragraph 1 who are nationals of the sending State and hold a valid diplomatic passport and family members of the persons who are nationals of the sending State and hold a valid service/official passport shall benefit from the same facilities insofar as they live in the same household and are recognised by the receiving State as family members entitled to stay with the person specified in paragraph 1.
Artikel 5
Notwithstanding Articles 3 and 4 of this Agreement, each State of a Party reserves the right to refuse to admit to its territory any person regarded as being undesirable or whose presence in the country is regarded as prejudicial to law and order or to national security.
Artikel 6
1. Except as herein provided this Agreement shall not affect the laws and regulations in force in the States of the Parties governing entry, length of stay, residence and expulsion and any form of occupation of foreigners.
2. This Agreement shall apply without prejudice to the rights, obligations and responsibilities of the Parties arising from other international agreements.
Artikel 7
The Parties shall provide each other, through diplomatic channels, with specimens of their new or modified national diplomatic passports and service/official passports, and also the particulars concerning the use of these passports, as far as possible, thirty (30) days before their date of introduction.
Artikel 8
Any dispute between the Parties arising from the application or interpretation of this Agreement shall be settled amicably through consultation or negotiations between the Parties.
Artikel 9
1. This Agreement may be amended by mutual consent of the Parties through an Exchange of Notes between the Parties through diplomatic channels. These amendments shall enter into force in accordance with the procedure laid down in paragraph 1 of Article 11.
2. The Parties shall inform the Depositary of the Exchange of Notes referred to in Paragraph 1 and shall send the Depositary their notification confirming that all constitutional and legal requirements for its entry into force have been fulfilled.
Artikel 10
The General Secretariat of the Benelux Union shall act as the Depositary to this Agreement. The Depositary shall provide each Signatory State with a certified copy of the original of this Agreement.
Artikel 11
1. This Agreement shall enter into force on the first day of the second month following the date of receipt by the Depositary of the last notification confirming that all constitutional and legal requirements for its entry into force have been fulfilled.
2. Notwithstanding paragraph 1, should the last notification be deposited before the entry into force of the Agreement between the States of the Benelux and Mongolia on readmission of persons staying without authorisation, this Agreement shall only enter into force on the date of the entry into force of the latter Agreement.
3. After the entry into force of this Agreement, each Party may denounce this Agreement by sending a written notification, through diplomatic channels, of its intention to denounce this Agreement to the Depositary not later than thirty (30) days prior to the date on which the denunciation is to take effect.
4. The denunciation by one Party shall cause this Agreement to terminate for both Parties.
5. The Depositary shall inform each State of a Party of the receipt of any notification referred to in this Article.
Artikel 12
Each Party may suspend the application of this Agreement. Suspension shall be notified immediately to the Depositary. The Depositary shall inform the States of the Parties of the receipt of such notification. The same procedure shall be adopted when the suspension is lifted.
Artikel 13
1. With regard to the Kingdom of the Netherlands, the application of this Agreement may be extended to Aruba, Curaçao, Sint Maarten and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius and Saba) by notifying the Depositary to that effect.
2. The Depositary shall inform the Parties of this extension.
