Overeenkomst tussen het Koninkrijk der Nederlanden en de Islamitische Republiek Pakistan inzake technische samenwerking

Artikel I

1. The aim of this Agreement shall be to promote technical cooperation on a grant basis and to create to that effect the legal and administrative framework for technical cooperation programmes and projects upon which the competent authorities of the two Parties may decide for the purpose of implementing the Agreement.

2. A decision to cooperate as referred to in paragraph 1 above, the contribution to a program or a project and the manner in which that programme or project is to be implemented shall in each case be the subject of a separate arrangement to be drawn up by the competent authorities, in accordance with the principles embodied in this Agreement.

Artikel II

In connection with a programme or project, the Government of the Islamic Republic of Pakistan shall:

a. a. exempt from payment of its income tax the remunerations received by a Netherlands expert from the Netherlands Government in accordance with the provisions of article 19 of the Convention of March 1982 for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income. b. b. provide the Netherlands personnel the customs and tax exemptions on household effects, personal belongings and consumer goods in conformity with rules which will not be less favourable than those applied to privileged personnel arriving in Pakistan under various foreign aid programmes and projects; c. c. provide the Netherlands personnel, free of charge, with entry-visas, identity documents and work permits to assure them of the full assistance of the appropriate Pakistan authorities in the performance of their duties; d. d. exempt the Netherlands experts or their dependants from national service obligations; e. e. grant the Netherlands personnel the most favourable exchange facilities, i.e. external accounts, for all their remunerations from the Netherlands; f. f. offer the Netherlands personnel and their families in Pakistan repatriation facilities at times of national or international crises; g. g. provide the Netherlands personnel with medical and dental facilities of the same standard as are made available to Pakistan civil servants of comparable rank; h. h. grant the Netherlands personnel immunity from legal action in respect of any acts performed or words spoken or written in their official capacity.

Artikel III

1. The Government of the Kingdom of the Netherlands and the Netherlands personnel shall not be liable for any civil claim arising out of any act or omission on the part of one or more members of the said personnel during the operations governed by or undertaken in connection with this Agreement causing the death or physical injury or damage to the property of a third party - in so far as such death, injury or damage is not covered by insurance - and the Government of Pakistan shall not be entitled to any claim or any action for liability unless such liability arises out of wilfull misconduct or gross negligence on the part of one or more of the individuals concerned.

2. The Government of the Kingdom of the Netherlands shall, if the Government of the Islamic Republic of Pakistan so requests, provide the competent authorities of the Islamic Republic of Pakistan with the administrative or legal assistance required to achieve a satisfactory solution of any problem that may arise in connection with the application of paragraph 1 of this Article.

Artikel IV

1.

The Government of Pakistan, after consulting with the Netherlands Government, will have the right to request the recall of any Netherlands personnel whose work or conduct is unsatisfactory.

The Netherlands Government, after similar consultations with the Pakistan Government, will have the right to recall any Netherlands personnel at any time.

In case of recall, the Netherlands Government will make every effort to obtain an adequate replacement for the recalled Netherlands personnel if the Government of Pakistan so requests.

All Netherlands personnel will carry out their assignment to be agreed upon by the respective competent authorities. As far as the daily operations of a project are concerned they will act in close consultation with the Pakistan authorities responsible for the execution of the project, and they shall respect the operational instructions given by those authorities.

Communications between the Netherlands personnel and the competent Netherlands authorities shall be dealt with in the respective programme or project arrangement.

Artikel V

The Government of the Islamic Republic of Pakistan shall exempt the equipment (including motor vehicles) and other supplies provided by the Netherlands Government in connection with a programme or a project from harbour and airport dues, all import and export duties, storage and other official charges.

Artikel VI

The provisions of this Agreement concerning Netherlands personnel shall apply equally to all persons, other than Pakistan nationals, employed by the Netherlands Government and to all persons, other than Pakistan nationals, employed by companies with which the Netherlands Government has concluded a contract to engage in operations governed by or undertaken in connection with this Agreement.

Artikel VII

For the follow-up and evaluation of the cooperation under this Agreement the competent authorities shall, whenever needed, be available to each other for consultations and shall give each other such relevant information on the cooperation as may be reasonably requested. The Government of the Islamic Republic of Pakistan shall furthermore, whenever appropriate and practicable, enable representatives of the Government of the Netherlands to study the various activities supported by the Netherlands Government.

Artikel VIII

1. This Agreement shall enter into force on the date on which the two Governments have given each other written notification that the procedures constitutionally required therefor in their respective countries have been complied with.

2. This Agreement shall remain in force for an initial period of two years. If neither Government declares its intention to terminate the Agreement three months before it expires, the Agreement shall each time be tacitly renewed for a further period of one year.

3. In respect of programmes or projects started before the date of termination of this Agreement, the foregoing articles shall continue to apply until the programme or project has been terminated.

4. With respect to the Kingdom of the Netherlands this Agreement shall apply to the European part of the Kingdom only.
