Samenwerkingsverdrag tussen het Koninkrijk der Nederlanden en de Internationale Organisatie voor Migratie
Artikel I
1.
Upon mutual agreement between IOM and the Netherlands, IOM shall implement the following migration programmes and activities:
a) a) assisted voluntary return programmes for asylum seekers and other aliens; b) b) other programmes and activities.
2. Modalities concerning the implementation of such programmes and activities shall be agreed upon between IOM and the Netherlands.
Artikel II
1. For the purpose of carrying out the programmes and activities mentioned in Article I, IOM shall maintain an Office in the Netherlands and shall appoint the staff needed to implement its tasks.
2. IOM Staff members shall be subject to IOM Staff Regulations for Officials or Employees, as the case may be, and to any rules that may be issued by IOM.
Artikel III
The Netherlands shall contribute to the costs of the programmes and activities mentioned in Article I.
Artikel IV
IOM shall submit to the Netherlands, each year prior to 1 May, a report regarding its activities of the previous year.
Artikel V
Representatives of the Netherlands and IOM shall meet periodically to ensure the proper implementation of this Agreement and to consider any measure which they may deem necessary to further the objectives of their cooperation.
Artikel VI
Any dispute concerning the interpretation or application of this Agreement, which can not be settled by negotiation, shall be referred for final decision to a tribunal at the request of either IOM or the Netherlands.
Each party shall appoint one arbitrator, and the two arbitrators so appointed shall appoint the third one who shall be the chairman of the tribunal.
Artikel VII
With respect to the Kingdom of the Netherlands, this Agreement shall apply solely to the part of the Kingdom in Europe.
Artikel VIII
1. This Agreement shall enter into force on the date on which the Kingdom of the Netherlands notifies IOM in writing that its constitutional procedures have been completed.
2. Upon its entry into force, this Agreement shall replace the Agreement between the Kingdom of the Netherlands and the International Organization for Migration on the Organizations's Operational Activities in the Netherlands, concluded on 1 May 1990, without prejudice to the continuing validity of separate arrangements concluded on the basis of the said Agreement.
3. This Agreement shall cease to be in force twelve months after either IOM or the Kingdom of the Netherlands shall have given notice in writing of its decision to terminate the Agreement.
