Overeenkomst tussen het Koninkrijk der Nederlanden en de Arabische Republiek Egypte inzake technische samenwerking

Artikel I

In case both Governments have decided to collaborate in a particular project of technical cooperation (hereinafter referred to as a “Project”) the mutual contributions to that project as well as the implementation thereof shall in each individual case be established in administrative arrangement, to be agreed upon by the respective administrative authorities in accordance with the principles embodied in this Agreement.

Artikel II

In connection with a project, the Government of the Arab Republic of Egypt will:

a. a. exempt the Netherlands personnel from all taxes and other fiscal charges in respect of all remunerations paid to them by the Netherlands Government; b. b. exempt the Netherlands personnel and their dependants from import and custom duties on new or used household effects and personal belongings, as well as professional equipment, imported into Egypt within six months of their arrival, provided that such goods are re-exported from Egypt at the time of departure or within such period thereafter as may be acceptable to the Government of the Arab Republic of Egypt; c. c. make provisions for duty-free importation or purchase from bond by the Netherlands personnel of one motor-vehicle within six months of first arrival in Egypt, provided that such vehicle if sold to a person not likewise privileged, shall be subject to payment of an appropriate import duty based on the estimated value of the vehicle at the time of its being sold; d. d. authorize the Netherlands personnel to buy consumer goods duty free from the tax-free shops in Egypt to a monthly limit to be agreed upon by both parties; e. e. authorize the Netherlands personnel to import sundries including medicine and presents by parcel post according to local regulations in force; f. f. authorize the Netherlands personnel to remit 50% of their local allowances to their home country in accordance with regulations valid for foreign technical assistance personnel working in Egypt; g. g. make provisions for the issue, free of charge, of entryvisas and workpermits, to the Netherlands personnel employed or to be employed by the Netherlands Government for the implementation of a project; h. h. exempt the Netherlands personnel and their dependants from national service obligations; i. i. grant the Netherlands personnel, as far as their Netherlands remunerations are concerned, the most favourable exchange facilities, i.e. external accounts; j. j. offer the Netherlands personnel and their families in Egypt repatriation facilities in time of national or international crises; k. k. grant the Netherlands personnel immunity from legal actions in respect of any words spoken or written and in respect of any acts performed by that personnel in their official capacity; l. l. provide the Netherlands personnel with identity documents to assure them of the full assistance of the appropriate authorities of Egypt in the performance of their duties; m. m. exempt the Netherlands personnel from normal immigration restrictions, subject to requirements to register with the Egyptian police and to obtain a residence permit, which will be granted to them.

The personnel will be exempted from dues on registration or on residence.

Artikel III

a. The Government of the Arab Republic of Egypt shall indemnify and hold harmless the Government of the Kingdom of the Netherlands and the Netherlands experts, advisers, agents or employees against any extra-contractual civil liability arising from any act or omission on the part of one or more of the said individuals during the operations governed by or undertaken in virtue of this Agreement which causes the death or physical injury of a third party or damage to the property of a third party - in so far as not covered by insurance - and shall abstain from making any claim or instituting any action for extra-contractual liability unless such liability derives from wilful misconduct or gross negligence on the part of one or more of the said individuals.

b. If the Government of the Arab Republic of Egypt has to hold harmless the Government of the Kingdom of the Netherlands or one or more of the said individuals against any claim or action for extracontractual civil liability in accordance with paragraph a of this Article, the Egyptian Government shall be entitled to exercise all the rights to which the Netherlands Government or the individuals are entitled.

c. If the Government of the Arab Republic of Egypt so requests, the Government of the Kingdom of the Netherlands shall provide the competent authorities of Egypt with the administrative or judicial assistance required to reach a satisfactory solution of any problems that may arise in connection with the application of paragraphs a and b of this Article.

Artikel IV

The Government of the Arab Republic of Egypt will have the right to request the recall of any expert whose work or conduct is unsatisfactory. Before exercising such right the Government of the Arab Republic of Egypt will inform the Government of the Kingdom of the Netherlands. If the Government of the Arab Republic of Egypt so requests, the Government of the Kingdom of the Netherlands will make every effort to obtain a replacement for the recalled expert.

Artikel V

The Government of the Arab Republic of Egypt will exempt from all import duties and other public charges the equipment (inclusive motor-vehicles) and other supplies provided by the Netherlands Government in connection with a project.

Artikel VI

All equipment and materials supplied by the Netherlands Government in connection with a project shall remain the property of the Netherlands Government for the duration of a project and will be transferred to the Government of the Arab Republic of Egypt when the cooperation between the two Governments on that project has terminated, unless they are required for some other technical cooperation project involving the two Governments.

Artikel VII

The Government of the Arab Republic of Egypt will provide for the Netherlands personal privileges no less favourable than those accorded to foreign experts of other countries involved in technical assistance in the Arab Republic of Egypt. In case the Arab Republic of Egypt is providing new privileges to experts in the framework of technical cooperation with other countries, these privileges will also be applicable to the personnel concerned under the present Agreement.

Artikel VIII

a. This Agreement shall enter into force on the date on which both Governments have informed each other in writing that the procedures constitutionally required therefor in their respective countries have been complied with. This Agreement however may provisionally be applied as from the date of its signature by both parties.

b.

This Agreement shall remain in force for an initial period of two years. If it has not been denounced three months before the date of its termination, it shall be tacitly renewed, for periods of ONE year subsequently.

Each Government shall then have the right to denounce the Agreement at any time giving three months notice to the other Government.

c. In respect of projects started before the date of termination of the present Agreement the foregoing articles thereof shall continue to be effective until the project has been terminated.
